Terms and Conditions of the “Peach Lovers” Loyalty Program

The “Peach Lovers” Loyalty Program is promoted by Fuchsiatraente, Lda. , owner of the Blackpeach.pt brand, and is governed by these Terms and Conditions. Participation in the program implies full acceptance of these rules.

1. Program Objective

The “Peach Lovers” Program allows customers to accumulate points (“Peachies”) through purchases and interactions with the brand, which can later be exchanged for benefits, discounts, and rewards.

2. Joining the Program

Membership is free and can be obtained by creating an account at blackpeach.pt .
Only those 18 years of age or older may participate.
Each customer can only have one account associated with the program.

3. How to Earn Peachies

Customers can accumulate Peachies in the following ways:

Purchases: 2 Peachies for every R$1 spent (final amount paid, excluding shipping and discounts).
Welcome bonus: Points awarded upon account creation.
Newsletter: Points awarded upon successful subscription.
Birthday: Annual bonus awarded automatically.
Social Media: Points for following the official pages on Instagram and TikTok.
Ratings: Points for reviews of purchased products.
Refer a Friend: Points are awarded when the invited friend makes their first eligible purchase.

Fuchsiatraente may request proof or manually validate actions that involve external interaction (e.g., social media).

4. Exchange Peachies for Rewards

Peachies can be exchanged for:

Free shipping.
Discount coupons (5%, 10%, 15% or 20%).
Direct discounts (€5, €10, €15 or €20).

Important rules:

Only one reward can be used per purchase.
Coupons and discounts cannot be combined .
After the exchange, the reward is valid for 15 days .
Expired rewards cannot be reactivated.

5. Points Validity

Peachies expire after 6 months of inactivity (no purchases or valid interactions).
Fuchsiatraente will send alerts whenever possible, but managing your points is the customer's responsibility.

6. Automatic Adjustments

In the event of a full or partial return of a purchase, the Peachies awarded for that purchase will be automatically removed.
If the customer has already used Peachies in the meantime, the balance may become negative until new accumulation occurs.

7. Coupon Refund

The customer may, on their own initiative, return a coupon obtained through the exchange of Peachies, provided that it has not yet been used and is within its validity period.

The corresponding Peachies will be reset to the balance.
This rule does not apply to level rewards.

8. Level Rewards

Upon reaching certain levels (e.g., Peach Plus → Premium Peach), the customer receives exclusive rewards.

Rules:

Level rewards are granted only once per level reached.
If the customer goes down a level and then goes up again, she does not receive the reward again .
These rewards cannot be returned or converted into Peachies.

9. Level Progression

Progression depends on the accumulated value of purchases over the last 6 months.
Maintaining the level is subject to ongoing activity and criteria defined by Fuchsiatraente.

10. Fraud, Abuse and Misconduct

Fuchsiatraente may suspend or cancel participation in the program if it detects:

Creating multiple accounts by the same person.
Misuse of coupons or points.
Manipulating ratings, invitations, or interactions.
Any attempt at fraud, abuse, or violation of the Terms.

In these cases, accumulated Peachies may be cancelled without entitlement to compensation.

11. Program Changes

Fuchsiatraente reserves the right to:

Change, suspend, or terminate the program at any time.
Modify rules, accumulation values, levels, rewards, or terms of use.
Adjust or correct balances in case of a technical or operational error.
Limit or exclude customers from the program in case of abuse or default.

Whenever possible, changes will be communicated with reasonable advance notice via the website or email.

12. Limitation of Liability

Fuchsiatraente is not responsible for technical failures, delays, system unavailability, or errors caused by third parties.
Peachies have no monetary value, are not convertible into cash, and cannot be transferred between accounts.
Rewards are subject to stock availability and may change without notice.

13. Personal Data

The processing of personal data within the program complies with the General Data Protection Regulation (GDPR) and applicable Portuguese legislation.

14. Applicable Law and Jurisdiction

These Terms and Conditions are governed by Portuguese law.
In the event of a dispute, the court of the area where Fuchsiatraente's headquarters are located shall have jurisdiction, unless otherwise expressly provided by mandatory law.
